The High Court ruled that Sengar was not a 'public servant' under the POCSO Act definition at the time of the offence. However, Sengar remains in prison for the custodial death of the victim's father. The Central Bureau of Investigation (CBI) has moved the Supreme Court seeking a stay on the High Court's order, citing safety concerns for the victim. A special bench comprising Chief Justice of India Surya Kant, Justice J.K. Maheshwari, and Justice A.G. Masih is set to hear the matter.
